영국, "반동성애 노방전도자 집단 폭행당하고, 벌금형 처해졌다"?

국민일보는 얼마 전 ‘동성애 반대’ 성경 말씀 전했는데… 캐나다 대법원 혐오범죄 판결 신앙의 자유 빼앗는 포괄적 차별금지법 <2> ‘혐오표현’ 처벌의 목적이라는 제목의 기사(2020.07.16)를 냈다. 글쓴이는 전윤성 미국변호사 (자유와평등을위한법정책연구소 연구실장)이다. 그의 주장 가운데 아래와 같은 내용을 짚어본다.


 

주장 : 영국의 노방전도자 해리 하몬드

해리 하몬드는 영국의 노방 전도자였다. 2001년 노방 전도를 하다가 40명의 군중에 의해 집단 폭행을 당했다. 그는 “그리스도는 평화를 주십니다. 그리스도는 살아 계십니다. 비윤리적인 행위를 그만 하세요. 동성애를 그만 하세요. 레즈비언이 되지 마세요. 그리스도는 주님이십니다”라고 적힌 대자보를 들고 있었다.

​군중은 그를 둘러싸고 밀쳐서 넘어지게 했다. 그리고 오물을 던지고 대자보를 끌어 내렸다. 출동한 경찰은 그를 보호한 것이 아니라 체포했다. 그에게 폭행한 군중은 단 한 명도 체포되지 않았다.

​그는 혐오표현을 금지하는 영국 공공질서법에 따라 기소돼 유죄 판결을 받았다. 법원은 그가 사람들의 기분을 상하게 할 것을 알고도 비이성적으로 대자보를 들었다고 판시했고, 벌금형을 선고했다. - 국민일보(2020.07.16)


 

사실 확인

국민일보에 위와 같은 주장을 담은 전윤성 변호사의 주장은 그의 연구 결과인가? 아니면 다른 자료의 도움을 받은 2차 자료(주장) 인가? 그의 주장에 담겨 있는 사실은, 사실 그대로인가? 실제 벌어진 사건과 위의 글에서 서술하고 있는 내용은 같은가? 다른가? 위의 글은 실제 일어난 일을 제대로 서술한 것인가? 아니면 어떤 부분을 말하지 않는 있는가? 강조하고 있는 것은 무엇이고, 빠뜨린 혹은 감춘 사실은 없는가?

​그런데 전 변호사의 글에 담긴 위의 주장은 다른 자료를 그대로 옮겨 적은 것으로 보인다. 아래의 두 개의 글을 비교를 해보자.

◯ 해리 하몬드 노방 전도 사건

​- 해리 하몬드는 69세의 영국의 노방 전도자였는데 2001년에 노방 전도를 하다가 40명의 화난 군중으로부터 폭행을 당함. 그는 “예수님은 평화를 주십니다. 예수님은 살아 계십니다. 비윤리적인 행위를 그만하세요. 동성애를 그만 하세요. 레즈비언이 되지 마세요. 예수님은 주님 이십니다.”라고 적힌 대자보를 들고 있었음. 

​군중들은 그를 둘러싸고 밀쳐서 땅에 넘어지게 했고, 물과 흙을 그에게 던지고 대자보를 끌어 내렸음. 경찰이 출동했으나 그를 보호한 것이 아니라 오히려 체포함. 폭행을 한 군중은 단 한 명도 체포되지 않았음. 

​그는 영국 공공질서법에 의해 기소가 되어 유죄 판결을 받았고, 불행하게도 다음해 사망하였다. 법원은 그가 기분을 상하게 할 것을 알고도 비이성적으로 대자보를 들었다고 하면서 벌금형을 선고함. 

​사소한 차이가 있지만, 전 변호사의 글과 내용과 짜임새가 동일하다.

​전윤성 : 그는 “그리스도는 평화를 주십니다. 그리스도는 살아 계십니다. 비윤리적인 행위를 그만 하세요. 동성애를 그만 하세요. 레즈비언이 되지 마세요. 그리스도는 주님이십니다”라고 적힌 대자보를 들고 있었다.

B 자료: 그는 “예수님은 평화를 주십니다. 예수님은 살아 계십니다. 비윤리적인 행위를 그만하세요. 동성애를 그만 하세요. 레즈비언이 되지 마세요. 예수님은 주님 이십니다.”라고 적힌 대자보를 들고 있었음. 

​' 예수님->그리스도'로 단어만 다를 뿐이다. 심지어 '대자보'라는 단어까지 동일하다. '대자보'? 이것은 플래카드(placard)의 완전한 오역이다. 플래카드는 우리나라에서 사용하는 플래카드와 달리 피켓의 의미로도 사용한다. 이 사건의 맥락을 보면, 피켓으로 풀이하는 것이 적절하다.

​이런 것을 볼 때, 전 변호사의 글에 담긴 내용은, B 자료를 그대로 옮겨 적은 것으로 볼 수 있다. 아니면 전 변호사의 글을 B 자료가 그대로 옮겨 적은 것으로 볼 여지도 있다. 그렇지만, 최소한 언론을 통해, 이같은 주장의 공유 과정을 살펴보면, 전 변호사가 B 자료를 공유한 것으로 볼 수 있다.

​B 자료는, "종교적 신념과 관련한 문제를 법제화하는 과정에서 발생하는 사회적 현상"(2017년도 국회운영위원회 정책연구개발용역 최종 보고서, 2018.02.27) 135쪽에 나오는 것이다. 이 연구는, '연구책임자: 음선필 교수, 공동연구자: 민성길 교수, 길원평 교수, 조영길 변호사, 이상현 교수' 등이 진행한 것이다. 이 연구자 모두는 차별금지법 반대에 목소리를 함께 내고 있는 것으로 보인다.

실제 일어난 사실 확인

​이제 2001년에 노방전도 현장에서 실제 일어난 사건으로 다가서 본다. 해리 하몬드는 누구인가? 그는 어떤 행동을 했고, 그래서 어떤 일이 벌어졌나?

 

2001년 10월 13일, 영국 Bournemouth 광장 주변에서 벌어진 일이다. 해리 하몬드(Harry John Hammond, 당시 69세), 그가 들고 있던 피켓에는 이렇게 적혀 있었다고 관련 자료는 말한다. "Jesus Gives Peace, Jesus is Alive, Stop Immorality, Stop Homosexuality, Stop Lesbianism, Jesus is Lord" 이것을 보면, 전윤성 변호사보다 연구자들이 그대로 옮긴 것이다.

사건의 경과 과정은 위에서 인용한 흐름으로 진행된 것으로 보인다. 그에게 적용된 규정은 영국 공공질서법(the Public Order Act 1986) 제5조 Harassment, alarm or distress 금지 규정 위반은 아래와 같다.

​(1) A person is guilty of an offence if he/she: (a) uses threatening [or abusive] words or behaviour, or disorderly behaviour, or (b) displays any writing, sign or other visible representation which is threatening [or abusive], within the hearing or sight of a person likely to be caused harassment, alarm or distress thereby."​

그가 위반한 것이, '성적 지향에 근거하여 증오를 확산시킬 의도를 가지고 행하는 표현과 행위를 범죄로 규정'(Sec.29 AB) 한 조항이었다는 주장도 있다. 그렇지만, 공공질서법 제3장 인종과 종교적 혐오 금지 규정(Racial and Religious Hatred Act 2006), 29조 A 항과 B 항의 내용은 아래와 같다. ​

​SSection 29A: Meaning of "religious hatred" In this Part "religious hatred" means hatred against a group of persons defined by reference to religious belief or lack of religious belief.

Section 29B: (1) A person who uses threatening words or behaviour, or displays any written material which is threatening, is guilty of an offence if he intends thereby to stir up religious hatred.

선고가 내려진 것은 2002년 4월 24일 치안법정에서의 일이다. 재판부는 23, 24일 이틀간의 심리를 마친 뒤에, 해리 하몬드에게 벌금 300파운드(약 450달러), 소송비용 395파운드(약 600달러), 피켓 파기 명령을 내렸다. 해리 하몬드는 당시에 아스퍼거 증후군(Asperger Syndrome)을 앓고 있었던 것으로 보인다. 이 재판 뒤인 그해 8월 중순에 사망했다.


주장에 대한 평가

위의 주장은 사실과 사실이 아닌 것, 사실과 다른 것, 다소간에 사실을 왜곡한 부분이 뒤섞여 있다. 붉은색으로 표시한 부분이다. 왜 이 부분이 사실 왜곡에 해당할까?

​"해리 하몬드는 영국의 노방 전도자였다. 2001년 노방 전도를 하다가 40명의 군중에 의해 집단 폭행을 당했다.", "군중은 그를 둘러싸고 밀쳐서 넘어지게 했다. 그리고 오물을 던지고 대자보를 끌어 내렸다.", "출동한 경찰은 그를 보호한 것이 아니라 체포​했다. 그에게 폭행한 군중은 단 한 명도 체포되지 않았다."

"해리 하몬드는 ... 40명의 군중에 의해 집단 폭행을 당했다."?

​30, 40여명의 군중이 몰려있던 것은 맞다. 그러나 그들에 의해 폭행이나 집단 폭행은 벌어지지 않았다. 해리 하몬드 사후에 진행된 재판에서 유족측에서 법정에서 한 진술을 언급한 내용은 아래와 같다. 유럽인권법원 기록도 같이 옮겨본다.

​“He (Hammond) was subjected to a number of assaults. Soil was thrown at him and water poured over his head. Someone tried to seize the sign and he was knocked to the ground." - 위키페디아

​"... some threw soil at him. At one point, someone tried to snatch the sign away from him and it struck someone on the head. A struggle ensued during which Harry Hammond fell to the ground. He got up and continued preaching, holding up the sign. At this point, someone poured water over his head."- 유럽인권법원 기록

"군중은 그를 둘러싸고 밀쳐서 넘어지게 했다."?

​해리 하몬드가 들고 있던 피켓을 두고 옥신각신이 이뤄지는 과정에서 해리 하몬드가 넘어진 것으로 진술하고 있다. 집단 폭행은 없었다. 군중이 그를 둘러쌌다는 표현은 과장된 것이다.

"군중은 ... 오물을 던지고 대자보를 끌어 내렸다."?

​충돌 과정에 누군가가 그에게 오물이 아니고 그의 머리에 물을 뿌렸다. 대자보를 끌어내린 것이 아니라, 피켓을 빼앗으려고 했다. 큰 차이는 없지만, 이 표현이 그려주는 분위기는 적잖이 다르다. 또한 피켓을 두고 충돌하는 과정이 그곳에 있던 다른이가 피켓에 머리를 맞은 것으로 보인다.

"출동한 경찰은 그를 보호한 것이 아니라 체포했다."?

​이 표현 안에는 사실과 다소 왜곡된 주장이 뒤섞여 있다. 경찰은 그를 보호하려는 노력도 시도한 것으로 보인다. 현장에 있던 두 명의 경찰 중 한 명은 그에게 현장에서 떠나줄 것을 요청하기도 했다. 재판 결과를 언급한 아래 자료 등에는 현장에 있던 경찰관 가운데, 그에게 피켓(시위)을 내리고 현장을 떠나줄 것을 요청했으나 그가 거부한 것으로 말한다. 경찰은 일방적으로 그를 체포한 것이 아니었다.

"그에게 폭행한 군중은 단 한 명도 체포되지 않았다."?

​폭행한 군중이라는 표현 안에 사실 왜곡이 있다. 아래의 기록에도 나오듯이 해리 하몬드도 체포되지 않을 수 있는 상황이었다. 상호간에 충돌이 있었던 것과 그것을 폭행으로 묘사한 것 사이에는 차이가 크다. 폭행한 군중은 없었던 것으로 재판 기록은 묘사하고 있다.

유럽인권법원 재판 기록에는 아래와 같은 언급이 담겨 있다. (이 글의 끝부분에 이 사건 경과에 대한 법원 기록 내용을 옮겼다)

​"Two police constables, Ms Gandy and Mr Elliott, arrived at the scene. PC Gandy found the crowd to be angry, agitated and insulted. She asked Harry Hammond to put away the sign and leave. He refused. He declared that he was aware that people found the sign insulting as he had had a similar reaction previously. PC Elliott was of the opinion that it was not necessary for the police to take any action. 해리 하몬드의 사례를 '동성애는 죄이다'라고 설교한 것으로, 차별금지법에 의해 역차별을 당한 사례로 언급한 이들은, 왜 사실과 적잖이 다른 이런 차이를 감지하지 못한 것일까? 왜 이런 표현을 쓴 것일까? 그러한 사례를 재인용하는 이들은 왜 실제 벌어진 일에 대한 사실 확인을 하는 수고를 게을리한 것일까?


The facts of the case, as submitted by the applicants, may be summarised as follows.

Mr Harry Hammond, born in 1932, was an evangelical Christian who had been preaching for twenty years. His religious beliefs were deeply held and he had a desire to convert others to his way of thinking.

During the summer of 2001, Mr Hammond had a large double-sided sign made, bearing the words “Stop Immorality”, “Stop Homosexuality” and “Stop Lesbianism”. The sign, attached to a pole, also bore in each corner the words “Jesus is Lord”.

Prior to 13 October 2001 Harry Hammond had on at least one occasion preached in public while displaying the sign and had received a hostile reaction from members of the public, some of whom attempted to deface or destroy the sign.

On the afternoon of Saturday, 13 October 2001, Harry Hammond travelled by bus into Bournemouth. He covered the sign with a plastic bin liner for the trip as he believed, in light of previous reactions, that it might provoke a disturbance if displayed inside the bus. He then took up position in The Square, a pedestrian area of the town centre, and began preaching, holding up the sign.

A group of thirty to forty people gathered around him, arguing and shouting. Some were angry, others aggressive or distressed; some threw soil at him. At one point, someone tried to snatch the sign away from him and it struck someone on the head. A struggle ensued during which Harry Hammond fell to the ground. He got up and continued preaching, holding up the sign. At this point, someone poured water over his head.

Two police constables, Ms Gandy and Mr Elliott, arrived at the scene. PC Gandy found the crowd to be angry, agitated and insulted. She asked Harry Hammond to put away the sign and leave. He refused. He declared that he was aware that people found the sign insulting as he had had a similar reaction previously. PC Elliott was of the opinion that it was not necessary for the police to take any action. PC Gandy took the view that he was provoking violence and arrested him for breach of the peace.

On 4 December 2001 Harry Hammond was charged with an offence under the Public Order Act 1986, in that he had displayed a sign which was threatening, abusive or insulting within the hearing or sight of a person likely to be caused harassment, alarm or distress, contrary to section 5(1) of the Act.

The case was heard before magistrates on 23 and 24 April 2002. On 24 April 2002 the magistrates convicted Harry Hammond, finding that he had known that insult, distress and disturbance were likely to be caused but had refused to put away the sign or leave when requested. He was fined 300 pounds sterling, with prosecution costs. The sign was confiscated.

Mr Hammond appealed to the High Court by way of case stated. In their statement of case dated 9 July 2002, amended on 7 January 2004, the magistrates declared that they had considered his Convention rights but found that there had been a pressing social need to restrict his freedom of expression to prevent disorder. They gave the following reasons.

(a) The words displayed on the sign were in fact insulting and caused distress to persons who were present.

(b) The appellant was aware that the words on the sign were insulting; he admitted this to PC Gandy. His awareness was also demonstrated by his covering the sign with a black plastic bin liner while travelling on the bus and acknowledging that he had received a similar reaction in the past.

(c) The restriction on the appellant's right to freedom of expression had the legitimate aim of preventing disorder in view of the reaction of people in the crowd to the sign.

(d) There was a pressing social need for the restriction and the restriction corresponded to that need. The words on the appellant's sign were directed specifically towards the homosexual and lesbian communities, implying that they were immoral and there was a need to show tolerance towards all sections of society. The sign was displayed in the town centre on a Saturday afternoon, provoking hostility from members of the public.

(e) The interference with the appellant's right to freedom of expression by prosecuting him was a proportionate response in view of the fact that his behaviour went beyond legitimate protest, was provoking violence and interfered with the rights of others.

(f) Although the appellant knew that insult, distress and disturbance were likely to be caused by using the placard, having received a similar reaction in the past, he refused to put away the sign or leave at PC Gandy's request.

On 16 August 2002 Harry Hammond died. The executors of his estate were granted permission on 10 November 2002 to continue the appeal.

After a hearing on 13 January 2004, the Divisional Court dismissed the appeal.
